Family Conflict: Taking Care Of An Elderly Parent
Titled “Lawyers (72)” in Pages is an email to an MP asking for assistance with a lawyer to take up my case. I needed a lawsuit against my youngest sister in a dispute over the care of our elderly mother. Although she is alert and able to converse, she has diminished mental capacity because of very poor memory.
The dispute is about the drug Atorvastatin (the statin) that is given to her causing her to weaken and to complain immediately even with 5 min of light exercises by the bed.
She was able to do all the exercises asked of her at 2 rehabilitation centres when she was not on the statin, but once on the statin, her physical condition has deteriorated so that she now complains. The evidence shows it is due to the side effects of the statin and 3 doctors had either stopped it or wanted to check her for its side effects.
However, my siblings have considerable backing from people in government that I have been unable to engage a lawyer who will bring it to court. The lawsuit will require an investigation into the number of incidents of scheming and blocking and a medical assessment and psychiatric report of our mother if necessary.
I think the lawsuit is likely to be uncontested and could be the reason why it was blocked. If contested the amendments under Courts (Civil and Criminal Justice) Reform Bill allows for amicable resolution that was passed recently.
